Rules and Regulations Under the Freedom of Information Act
Village of Homer Glen
- Nonexempt public records are available for inspection and copying at the Village Clerk's Office.
- The charge for copies of records provided in response to F.O.I.A. requests shall be 10? per 8-1/2 x 11 page for copies made by the Village. If the Village needs to utilize an outside copy service for making copies, the charge to the requester shall be that charged to the Village by the copy service provider.
- All requests for public records must be made in writing upon Form 1011, Request for Copies of Public Records, attached hereto, and directed to the Village Clerk, who shall serve as the Village F.O.I.A. officer.
- All requests for public records shall be acted upon with seven (7) working days of receipt of written request unless additional time is required and notice of such fact is provided pursuant to Form 1012, Notice of Need for Additional Time, attached hereto.
- Failure to act upon a written request within fourteen (14) working days of receipt of such request shall be deemed a denial.
- Approval of request for public records shall be made upon Form 1013, Action Report, attached hereto.
- Denial in whole or part of request for public records shall be made upon Form 1014, Notice of Denial, attached hereto.
- Denials of request for public records may be appealed to the Village Mayor by completing a Notice of Appeal and submitting the same to the Village Clerk within seven (7) working days of the date of such denial. Appeals shall be made upon Form 1015, Notice of Appeal, attached hereto, or in a manner substantially in compliance with Form 1015.
- The Village Mayor shall, upon receipt of such Notice of Appeal, review the records and determine whether the decision to deny was correct. The Village Mayor shall notify the appellant of his decision, on Form 1016, Decision of F.O.I.A. Appeal, attached hereto, within seven (7) working days of receipt of the Notice of Appeal.
- All decisions made by the Village Mayor are final, subject only to judicial review.
